WISE "? A former teacher's aide at Powell Valley High School pleaded guilty to three counts of felony sexual misconduct on Wednesday and will have to spend 30 days in jail.

Darlene A. Blagg, 36, 2200-D Egan Road, Big Stone Gap, was charged earlier this year with having an improper relationship with a senior male who recently graduated from PVHS. On Wednesday, the former teacher's aide pleaded guilty before Wise County Circuit Judge Joseph Carico in a plea agreement worked out with prosecutors.

Wise County Commonwealth's Attorney Ron Elkins said the victim's family agreed to the terms brought before Carico on Wednesday, and the family's wishes in the matter served justice in this case.

"The agreement goes by what our sentencing guidelines recommend, but even more important it's what the victim's family wanted also,"? Elkins said.

Blagg pleaded guilty to three counts of taking indecent liberties with a person under 18 while in a supervisory position over minors. Blagg was hired by the Wise County School Board at the beginning of the 2006-07 school year to assist an individual special-needs student at PVHS. The senior male Blagg entered into an intimate relationship with late last year was not the student assigned to the former teacher's aide.

Carico applied the terms of the plea agreement, which includes a suspended three-year prison term and to serve 30 days in the Southwest Virginia Regional Jail, two years supervised probation and one year of unsupervised probation. She is to report to the jail facility in Duffield by 6 p.m. on June 15 to serve her 30 days.

Blagg must register as a certified sex offender, a lifelong status. Carico also ordered that Blagg have no further contact with the young man and never again pursue, let alone hold, a job that includes a supervisory role over minors. She must also pay court costs and already paid $80 restitution to the Wise County Sheriff's Department.

Elkins said Blagg offered apologies for her conduct to Carico on behalf of the victim and his family. He said Blagg also apologized for violating the trust of the county school division.

"She said (the school division) trusted her, and she violated that trust,"? Elkins said.

"She accepted responsibility all the way through (the legal process),"? Elkins said, at least after initially denying the illicit affair to the sheriff's investigator.

Blagg is married and the mother of two children, ages 5 and 2 at the time she was charged by a Wise County grand jury this past spring. Blagg is represented by Clintwood attorney Gerald Gray.

WISE - A former teacher's aide at Powell Valley High School accused of having a sexual relationship with a then-17-year-old student will be arraigned at 10 a.m. on Monday, Wise County Commonwealth's Attorney Ron Elkins said Friday.

Darlene A. Blagg, 36, 2200-D Egan Road, Big Stone Gap, faces nine counts of taking indecent liberties with a juvenile under 18 while in a custodial or supervisory role.

Each count carries a maximum five-year prison sentence.

During a press conference on Thursday, Elkins and lead Wise County Sheriff's Department Investigator Tim Wagner said negotiations were under way between Blagg and Wagner about when she would turn herself in to the magistrate and for processing. Wagner expected Blagg would voluntarily surrender to authorities on Friday.

However, Elkins on Friday said Blagg has secured the services of Clintwood attorney Gerald Gray, and the parties agreed to a 10 a.m. arraignment hearing in Wise County Circuit Court on Monday.

The male student's mother reported the allegations to the sheriff's department on March 13, about two weeks after complaining to school division authorities. County law enforcement officials said the mother reported inappropriate text messages sent to her son, who is now 18, and identified Blagg as the source of the messages.

On Thursday, Elkins and Wagner said Blagg was "dismissed" from her job by school officials a week before they were notified of possible wrongdoing and began their investigation.

A school division official said Thursday that Blagg resigned last week.

School division Director of Secondary Education Gene Rowland said Blagg was hired at the beginning of the current school year. She was assigned to assist a specific student, who is handicapped. That student is not the victim, Elkins emphasized on Thursday.

Elkins noted that while school administrators had not notified the sheriff's department of a possible problem, the school division did report the matter to the Wise County Department of Social Services.

Blagg is married and the mother of two children ages 5 and 2, Elkins said Thursday.

WISE - A recently resigned Powell Valley High School teacher's aide accused of having an illicit intimate relationship with a student is expected to voluntarily report to a magistrate today, Wise County officials said Thursday.

Darlene A. Blagg, 36, 2200-D Egan Road, Big Stone Gap, was named in nine counts by a Wise County grand jury on Wednesday of taking indecent liberties with a child under 18 while in a supervisory role. The charges carry a maximum prison term of five years each.

Authorities said Blagg is married and the mother of two small children, ages 5 and 2.

During a press conference at the county courthouse on Thursday, Wise County Commonwealth's Attorney Ron Elkins said Blagg has confessed to investigators to four of the counts. Blagg was assigned to assist a particular student at PVHS, Elkins said, but the student requiring the assistance is not the victim.

The male student Blagg is alleged to have engaged in a relationship with last December was 17 years old at the time and has since turned 18. Sheriff's investigators said they learned of the allegations about a week ago when the mother of the student reported the matter to the Wise County Sheriff's Department.

Elkins said Blagg had been "dismissed" as an employee of the Wise County school division about a week before sheriff's investigators were advised of the situation by the student's mother. However, Gene Rowland, director of Wise County's secondary education programs, said Thursday Blagg resigned her position last week.

"I don't know school policies on stuff like that," Elkins said when asked why the school division didn't report a possible sex crime allegedly committed by one of its employees. "My feeling is (school officials) wanted to make sure they were right about it before they did anything hasty. I think they wanted to do it the right way first so no false charges would be filed."

Rowland said Blagg was hired as an aide at the start of the current school year. The school division did contact the Wise County Department of Social Services "early on," Elkins said. DSS personnel are among the first to become involved in allegations of sex abuse of minors.

Investigator Tim Wagner has served as a deputy with the county since 1999. He was promoted as an investigator just a month ago and is the lead investigator in the case against Blagg. On Thursday, Wagner said he was in contact with Blagg to turn herself in to authorities for processing, and he expected that to occur today.

Elkins said processing includes an appearance before a magistrate, deliberations over bond or setting a bond hearing, arraignment date, and setting a court date within the next 60 to 90 days.

School officials "were cooperative" when he began his investigation, Wagner said.

The former teacher's aide was initially evasive when he first approached her about the allegations, he said.

"At first she told us lies, then when we really got into the interviews she confessed (to four of the nine counts)," Wagner said. Elkins said Blagg confessed her illicit involvement in the presence of other investigators besides Wagner.

Elkins said local authorities decided to hold a press conference because "we've had a lot of inquiries into this case. It seems to be a hot topic."

Elkins said he had nearly two dozen messages on his desk from state, national and international media outlets inquiring about the case.

I think justice was served in this case. I know both parties and I believe the victim's family was ok with this, afterall, they basically agreed to the terms of the plea.
